Course Introduction

"Company Law and Intellectual Property" is a general elective course specially designed for students majoring in industrial design. It aims to teach students basic knowledge of Company law and intellectual property law, build basic knowledge about the scope of intellectual property protection, ways of safeguarding rights, and infringement litigation for industrial design students based on subdivided knowledge content such as appearance patents, and teach students how to use for reference. How to distinguish the boundary between fair use and excessive plagiarism, and learn to more fully understand the relevant factors to consider in the identification of intellectual property rights. This course mainly focuses on the object of intellectual property protection in design and the way to distinguish it, including the establishment and organization of a company (the establishment and organization of a limited liability company and a joint stock limited company), copyright law, trademark law, patent law, etc. In the practical part of the course, we will investigate, classify and sort out the problems related to intellectual property encountered by teachers and students in the design research, extract representative cases for study and discussion, and publish reports. Through the teaching of this course, students will master the specific elements of intellectual property protection and the basic rules of infringement judgment, and be able to analyze intellectual property law cases by applying the theories of copyright law, trademark law and patent law, and distinguish the viewpoints of both sides in intellectual property disputes. At the same time, by focusing on the case of appearance patent, the students' comprehensive understanding of industrial design "innovation" is deepened, and the professional quality and legal awareness of future industrial design practitioners are enhanced, to shape the values and professional self-confidence of contemporary industrial design practitioners.
